VK hoax calls. Teen arrested.

A 19-year-old boy has been charged with hacking airport radio transmissions to pilots and air-traffic controllers at Melbourne and Avalon airports.

Paul (surname removed) of Rockbank, north-west of Melbourne, was arrested by the Australian Federal Police on Monday and faced Melbourne Magistrates Court on Tuesday afternoon.

He has been charged with four counts of endangering the safety of aircraft and one count of interference likely to endanger safety.

It has been alleged that ---- made 16 separate, unauthorised radio transmissions at Melbourne and Avalon airports between September 5 and November 3, with one call allegedly forcing a Virgin plane to abort its landing.

The offences carry a maximum penalty of 20 years’ jail.

He has been remanded until Monday, when he is expected to make an application for bail.

His lawyer told the court he had been diagnosed with autism and depression, but was not on any medication.

When the security breach was revealed earlier in the month John Lyons, president of Virgin Independent Pilots Australia, said that any person with the right knowledge using a simple VHF radio equipment could tap the transmissions.

“It’s not hard for someone to obtain,” he said. “There’s a lot of people that spend a lot of time observing aircraft at airports, and many of them have radios that monitor frequencies. But most of them just listen.

“In a worst case scenario, an aircraft will be told to go around, but there’s an aircraft on a runway crossing that runway.”

Airservices Australia operations manager Steven Clarke told The Age there was no current threat to the safety and security of the travelling public as a result of the alleged transmissions.

“Airservices has appropriate procedures, processes and systems in place to ensure the safety of aviation operations at Melbourne and Avalon airports, and across the country and for the travelling public,” he said.


I have removed all reference's to the teens surname as it has no real relevance to us in this country & he has yet to be tried, let alone convicted.

Aspergers is within the Autistic spectrum according to the World Health Organisation.
Autism is a spectrum disorder. This meaning that to be defined as Autistic you need a set number of the aspects of Autism, but not all, or in any set combinations. So what we now term Aspergers & it is a relatively new diagnosis. Use to be included in what is defined as high functioning autism. The differential diagnosis between Autism & Aspergers is to a large extent more claimed, than defined & thus far from clear. And the claimed differential is not helped by the fact that Hans Asperger was one of the discoverers of Autism.
My guess would be that the solicitor used Autism as it's a better known diagnosis & that the individual concerned is high functioning. But that Autism looks like a better diagnosis, from a defence prospective in court than Aspergers. As for the depression, is that a reactive depression caused by the fact he was caught & now faces the prospect of prison time?

Sadly, lots of clinical and other conditions now get used as excuses for bad. Wha Ilie and not every person with mild or amazingly serious levels carries out criminal acts. The other day somebody cited diabetes as an e cause for shop lifting all sufferers must cringe when their condition is used as an excuse! Dyslexia sufferers get really cross when lazy spellers blame it on dyslexia. Most people with bad dyslexia make certain they never reveal It and use it as an excuse! The internet is full

Lose it! Working for Virgin would also rather make me think he would recognise the consequences! Lock him up up!

My wife works in a secure mental health setting as a dual qualified Nurse (Mental health & Learning disability.) I use to manage a rehab for people leaving long term detention with mental health needs & was a social worker.
The key word is "capacity." Does the individual have capacity to understand right from wrong, did they have a choice in doing what they did etc.
It can be really hard at times, when you feel that someone assaulted you or a colleague, fellow patient etc deliberately & simply because they could not get their own way. Yet the psychiatrist says, no. No capacity. On the other hand it can often come a big surprise to client, when the psychiatrist says, yes go ahead with the prosecution, they knew exactly what they were doing.
Diabetes could cause someone to be confused & walk out of a store without paying, or accidentally put something in a pocket or bag. Hypoglycaemia or low blood glucose (sugar) does cause confusion. But normally, for most, they would be preceded by warning signals, such as blurred vision, pins & needles, sweating or feeling shaky etc. Plus of course if they were arrested, then they would have been obviously confused & presumably would have told the Police at the time, the they thought their blood sugar was out of balance & the results of any check of blood sugar levels will have been recorded.
I use to work with a lot of young people with various levels of Autism. And one of the real issues is that someone can be perfectly capable of holding a good job down, yet completely incapable of dealing with certain parts of life in general.
A lot of very high achievers are known to have Aspergers & often they are lifes odd people.
Often people with Aspergers work in subjects such a computing or mathematics. As black & white subjects suit them. Lots of infamous computer hackers have Aspergers, as do some very well known individuals in the wider PC world.
People with Aspergers can be VERY VERY focused on a certain aspect of something, or a certain topic & normally to the detriment of anything else, including the consequences of that obsession.
Plus we have to remember that a lot of Medical opinion is just that. Opinion & open to professional debate & available for hire. Thus this weeks medical apologist may be next weeks valued prosecution witness, if the price is right.

I can't speak for Australia, but here in the UK, self harming in Prison is far from uncommon & most prisons are very good at dealing with it & if someone needs extra mental health input then they can refer inmates to forensic services.
My wife often use to go out & do assessments of prisoners & also to places like Rampton etc when they wanted to move someone back down the ladder to her regional forensic unit.
Accused people can also be detained within a forensic unit for assessment prior to a court case.
Claiming mental health issues is not an easy option. First unlike a normal prison sentence, you may not be released when your sentence has been served. Unless your mental health panel feel you are safe to release. If you are deemed to be unsafe to release, then you are not released.
And claiming mental illness does not automatically mean no more prison. Far from it. You could be deemed suitable for treatment within prison or transferred for the period of treatment. Many people who transfer from prison to forensic services are later transferred back to serve the rest of their sentence.
Plus life in a forensic unit need not be easier, in fact it can be far from it. In prison you are not watched as closely. In prison your behaviour, your responses to things & your conversation is not as constantly, or as closely under review. In a forensic unit it's what they do, they constantly evaluate your mental health through how you behave.
