A UV-5R is a transceiver, (transmitter & receiver) not a scanner (fast scanning receiver.) Which means unless you have a licence you cannot legally use it, not even on 446 licence free frequencies, as the 5R is not a legal licence free radio.
Having said the above, you will probably not have any issues using it on 446, providing you do not upset anyone.
Beyond 446, it's use is not advised, unless you either have a licence or only enter receive frequencies & the 5R does not make a good scanner as it is way to slow for more than a few channels. As most users have quick chats & you will miss more than you hear with such a slow scan.
