Pmr 446 Ch 16 and binatone ch9 447.00625

Got the 16 now EU legal pmr frequencies in my scanner, picked up some users yesterday using what would be channel 16 @446,19375, and they were using a ctcss code, surprised to hear anyone using these frequencies at the moment as not many manufacturers that I know off have took advantage of the extra 8 channels, I wonder if this Is a cheap Chinese Baofeng or similar and they are using frequencies out of the box.

Also does anyone know how binatone got away with allowing ch9 on 447.00625?

I have programmed my UV5R to have the new channels and I know that codeplugs for the TYT MD380 compiled by the ham community include dPMR and PMR 1- 16
If they are using ctcss my guess is that they are using out of the box radios and avoiding the kids on channel 1 by turning the knob as far as it goes!
A BF888 set to 16 should be scan mode so I don't think they are using them.

The CH9 on binatone radios were for factory testing, I agree that it is odd that its right outside the permitted area. Thank goodness it's 0.5w (we never exceed that  )
